If anything here ever conflicts with mandatory consumer law that protects you, that law wins.

Who you're agreeing with
11MHz operates the notes and tasks service available at 11mhz.com and through the 11MHz apps.
The company behind the service is registered in the Netherlands under the name 11MHz, Chamber of Commerce (KvK) number 08177087.
Throughout these terms, "you" means the person or organisation using the service, and "11MHz" means the company described above.

How these terms apply
By creating an account, using the service, or paying for a subscription, you agree to these terms. If you don't agree, don't use the service.
If you're using 11MHz on behalf of an organisation, you confirm that you have the authority to bind that organisation to these terms.

Your account
Most of 11MHz requires an account. When you create one, provide accurate information and keep it up to date.
You're responsible for keeping your credentials confidential and for activity that happens through your account. If you suspect unauthorised access, notify 11MHz at hello@11mhz.com as soon as possible.
Accounts are personal. Sharing an individual account with other people isn't permitted, unless 11MHz offers an explicit team or workspace plan.
You must be at least 16 years old to use 11MHz, or the minimum age of digital consent in your country if that is higher.

Acceptable use
You agree not to use 11MHz for anything illegal, infringing, or harmful to others.
You won't upload content that is unlawful, defamatory, or violates someone else's rights, including intellectual property and privacy rights.
You won't try to disrupt the service, probe its security without authorisation, or interfere with other users.
You won't reverse engineer, scrape, or systematically extract content from 11MHz, except where local law explicitly permits this and only to the extent permitted.
You won't resell, sublicense, or repackage 11MHz as your own product, and you won't use the service to distribute malware or to host illegal content.
11MHz can suspend or terminate accounts that violate this section. See "Suspension and termination" below.

Your content
You keep ownership of the notes, tasks, files, and other content you put into 11MHz.
To run the service, 11MHz needs a limited licence to store, process, and sync your content across your devices on your behalf. This licence exists only so the service can be delivered to you. It ends when you delete the content or close your account, subject to the short retention windows described below and in the Privacy Policy.
11MHz does not claim ownership of your content, does not use it to train AI models, and does not sell it.

Locked notes and recovery
11MHz offers locked notes that are encrypted with a recovery phrase only you hold.
11MHz cannot read locked notes and cannot recover them if the recovery phrase is lost. Keep it somewhere safe.
Loss of the recovery phrase results in permanent loss of access to the affected locked content. 11MHz cannot reset, restore, or recover it on your behalf. This is a deliberate property of the encryption model, not a service failure.

Subscription, billing, and cancellation
Paid 11MHz plans are offered as monthly subscriptions that renew automatically until you cancel.
Prices are shown at the point of purchase. Fees are charged at the start of each billing period through the payment provider 11MHz uses to process payments. VAT and other applicable taxes may be added.
You can cancel a subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then. 11MHz does not pro-rate refunds for partial months outside of the right of withdrawal described below.
If a payment fails, 11MHz may retry it and may suspend paid features after a reasonable grace period. Your account and your content remain available during this time.

Right of withdrawal
If you are a consumer in the EU, you have a 14-day right of withdrawal starting from the day your subscription begins.
To exercise this right, contact 11MHz at hello@11mhz.com or via the contact page within 14 days of subscribing.
Because 11MHz starts providing the service as soon as you subscribe, a proportionate fee may be retained for the days you used the paid service before withdrawing. The remainder of the subscription fee will be refunded to the payment method used.

Availability and changes to the service
11MHz aims for high availability and reliability, but does not guarantee that the service will be uninterrupted, error-free, or always up to date.
Maintenance windows, occasional outages, software updates, and changes to features are part of running a live service.
11MHz may change, add, or remove features over time. Where a material change reduces paid functionality you have already paid for, 11MHz will provide reasonable advance notice and, where appropriate, a refund or credit.

Suspension and termination
You can stop using 11MHz at any time. To delete your account permanently, use the option in your settings or contact 11MHz at hello@11mhz.com.
11MHz may suspend or terminate an account that violates these terms, abuses the service, fails to pay for an extended period, or poses a risk to other users or to the service itself. Where reasonable, 11MHz will give you notice and a chance to resolve the issue first.
After termination, you have 30 calendar days to export your content. After that period, 11MHz may permanently delete your data. Some records, such as invoices, may be retained longer where law requires.

Disclaimer and liability
11MHz is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, and without limiting your mandatory consumer rights, 11MHz disclaims all implied warranties relating to the service.
To the extent permitted by applicable law, 11MHz's total liability for any claim arising out of or relating to the service is limited to the subscription fees you paid to 11MHz in the 12 months before the event giving rise to the claim.
11MHz is not liable for indirect, incidental, or consequential damages, including loss of data, loss of revenue, or loss of goodwill, except where such limitation is not permitted by law.
Nothing in these terms limits or excludes liability for fraud, intent, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under mandatory consumer law.

Third-party services
11MHz uses a small number of third-party providers to operate the service, such as hosting, transactional email, payment processing, and error monitoring.
These providers act as processors on behalf of 11MHz under appropriate data processing agreements. The current list and details are available in the Privacy Policy and on request.

Governing law and disputes
These terms are governed by the laws of the Netherlands. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer law in your country of residence.
Disputes will be submitted to the competent court in the Netherlands. As a consumer, you also retain the right to bring proceedings in your country of residence where EU law allows.
EU consumers may also use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr.

Changes to these terms
11MHz may update these terms over time to reflect changes in the service or in law. The "last updated" date at the top tracks meaningful changes.
Material changes will be announced by email or in-app notification at least 30 days before they take effect. If you don't agree with a change, you can cancel your subscription before it takes effect. Continued use after the effective date means you accept the updated terms.
